Kansas · K.S.A. 60-1101 et seq.Kansas mechanic's lien deadlines: four months, three months for subcontractors, one year to sue

In Kansas, a person claiming a mechanic's lien files a verified lien statement with the clerk of the district court of the county where the property is, within four months after material was last furnished or labor last performed under the contract; the statement names the owner and the claimant, describes the property and itemizes the claim (K.S.A. 60-1102(a)). A five-month window with a notice of extension is available only for property other than residential property – a residence for no more than two families (60-1102(c)–(d)). A supplier or subcontractor working under the contractor files within three months after it last furnished material or labor, names the contractor, attaches an affidavit that any required warning statement was given, and serves a copy on an owner (60-1103(a), (c)). An action to foreclose must be brought within one year after the lien statement was filed (60-1105(a)).
