Kansas · K.S.A.Kansas real estate closing laws: a checklist for transaction coordinators

Kansas's rules for a home sale, as a transaction meets them: the register of deeds won't record the deed without a real estate sales validation questionnaire completed by the grantor, grantee or an agent, unless an exemption applies and is stated on the deed (K.S.A. 79-1437c, 79-1437e). When the home is a rental, whoever holds the landlord's interest when a tenancy ends – after closing, the buyer – is bound by the deposit rules, so the seller's deposits are settled at closing (K.S.A. 58-2550(f)). When the seller is a beneficiary of a transfer-on-death deed, the deed passes the property subject to mortgages, liens and medical assistance claims (K.S.A. 59-3504).
