Kansas · K.S.A. 58-2550Kansas tenant security deposits when you sell a rental

Kansas doesn't set a transfer procedure for deposits on a sale, but its Residential Landlord and Tenant Act makes the holder of the landlord's interest in the premises when the tenancy ends bound by the deposit rules (K.S.A. 58-2550(f)) – after closing, that's the buyer, so the seller's deposits are something to settle between the parties at closing. The rules the buyer inherits: a deposit may not exceed one month's rent for an unfurnished unit, or one and a half months' rent if furnished, plus up to half a month's rent more when pets are allowed (58-2550(a)). At the end of a tenancy, deductions for rent and damages are itemized in a written notice, and the balance is returned within 14 days after the charges are determined but no later than 30 days after the tenancy ends, possession is delivered and the tenant demands it; if the tenant makes no demand within 30 days, the landlord mails what's due to the last known address (58-2550(b)). A landlord who doesn't comply can owe the amount due plus damages of one and a half times the amount wrongfully withheld (58-2550(c)). The landlord also discloses in writing the manager and an owner or the owner's agent, kept current and enforceable against any successor landlord, owner or manager (58-2551).

The rules

  1. 1. Owner at the end is bound (58-2550(f))

The holder of the landlord's interest when the tenancy ends.

  2. 2. Limits (58-2550(a))

One month unfurnished, 1½ furnished, plus ½ for pets.

  3. 3. Return (58-2550(b))

Within 14 days of determining charges, no later than 30 days.

  4. 4. Penalty (58-2550(c))

1½ times the amount wrongfully withheld.

What the TC can do

  • Get the seller's list of each tenant's deposit and any pet deposit.
  • Put the deposit transfer or credit to the buyer in front of whoever is closing the sale.
  • Have the buyer update the manager and owner disclosure to the tenants.
