Texas · TREC 20-19 resale contractTexas final walkthrough checklist under the TREC resale contract

The TREC resale contract (20-19) has no separate walkthrough clause; the walkthrough rests on the buyer's right of access. Seller must let the buyer and the buyer's agents into the property at reasonable times, and must keep existing utilities on while the contract is in effect (¶7A). Unless agreed otherwise in writing, the seller must finish agreed repairs and treatments before the closing date, using licensed or commercially engaged persons, give the buyer documentation of the scope of work and payment, and arrange the transfer of transferable warranties at closing; if repairs are not done, the buyer may use the contract's remedies or extend closing up to 5 days (¶7F). Items the seller listed as exclusions must be removed before possession (¶2D). Possession is delivered in the property's present or required condition, ordinary wear and tear excepted (¶10A), and at possession the seller hands over smart-device access codes and removes their own connections (¶10B).

What the buyer checks

  • Utilities are on – the seller must keep them on until closing (¶7A).
  • Every agreed repair or treatment is done; the receipts and scope of work are in hand (¶7F).
  • Transferable warranties for the repairs will be transferred at closing (¶7F).
  • Items listed as seller's exclusions are gone; everything else conveyed is still there (¶2D).
  • The property is in its present (contract-time) or required condition, apart from ordinary wear and tear (¶10A).
  • A written list of smart-device codes, usernames and apps is ready; the seller's own access is removed (¶10B).

If something is wrong

  • Repairs not finished: the buyer may use the remedies in ¶15 or extend closing up to 5 days for the seller to finish (¶7F).
  • New damage or missing items: raise it with the agents before signing – agreements go in a written amendment.
  • Lender-required repairs are separate: neither party must pay unless agreed, and over 5% of the price the buyer may terminate (¶7E).

What the TC schedules

  • The walkthrough a day or two before closing, with time to fix a problem.
  • A reminder to the seller for repair receipts and warranty paperwork.
  • The smart-device list as a document on the deal.

Questions buyers and agents ask

Does the Texas TREC contract give the buyer a final walkthrough?

Not as a separate clause; paragraph 7A gives the buyer and agents access at reasonable times, which is how the walkthrough is done.

What if the seller has not finished the repairs by closing?

Under ¶7F the buyer may use the remedies in ¶15 or extend the closing date up to 5 days so the seller can complete them.

Does the seller have to leave smart home codes?

Yes. At possession the seller gives written access codes, usernames, passwords and apps and removes their own connections (¶10B).

ClosingCode puts the final walkthrough on every buyer deal as a dated step before closing and sends the client a walkthrough reminder draft in English or Spanish.
