Texas · TREC 57-0 · ¶2Texas Non-Realty Items Addendum (TREC 57-0): selling personal property with the house

In Texas, items that are not part of the real estate – a refrigerator not listed in the contract, furniture, a riding mower – are added with TREC Non-Realty Items Addendum 57-0. The seller conveys the listed personal property at closing for an additional sum written in the addendum, warrants owning it free of all encumbrances and does not warrant its condition or future performance. The form is approved for voluntary use; items that already convey under ¶2 of the TREC contract do not need it.

What the addendum says

  1. A. Items and price

For an additional sum, the seller conveys the personal property at closing. Each item is described carefully – description, model and serial numbers, location.

  2. B. Ownership

The seller represents and warrants owning the listed items free and clear of all encumbrances.

  3. C. Condition

The seller does not warrant or guarantee the condition or future performance of the items.

  4. Voluntary use

TREC approved 57-0 (10-10-11) for voluntary use by its licensees; it is listed among the addenda in ¶22 of the One to Four Family contract.

What already conveys under ¶2

  • ¶2B Improvements: the house, garage and attached fixtures, including built-in equipment and appliances, ceiling fans, wiring, plumbing and lighting fixtures, landscaping and outdoor cooking equipment.
  • ¶2C Accessories: for example window air conditioning units, stove, curtains and rods, blinds, door and mailbox keys, above ground pool and pool equipment, and controls with the seller's transferable rights to the apps used to control them.
  • ¶2D Exclusions: items the seller keeps must be listed and removed before possession – write them here, not in the non-realty addendum.

What the TC tracks

  • 57-0 signed by all parties and listed in ¶22.
  • The additional sum shown on the settlement statement as agreed.
  • Exclusions in ¶2D removed before possession.
  • Leased fixtures (solar, propane tank, security system) on the Fixture Lease Addendum, not on 57-0.

Questions about the Texas non-realty items addendum
