Texas · TREC 39-11Texas Amendment to Contract (TREC 39-11): what it can change

The TREC Amendment to Contract (39-11, effective July 1, 2026) is the form buyer and seller sign to change an executed Texas contract. Its boxes cover the sales price, repairs, the closing date, the closing-cost amounts in ¶12, lender-required repairs, an extension of the option period for an additional option fee, waiving the option, the Buyer Approval date of the financing addendum, and other modifications. Every changed date must be recounted on the deal's timeline.

What each box changes

  1. (1) Sales price

The cash portion, the financing and the new sales price.

  2. (2) Repairs

Additional repairs and treatments the seller completes; ¶7 of the contract governs them.

  3. (3) Closing date

    A new date in ¶9.

  4. (4)–(6) Money at closing

The amounts in ¶12 and how lender-required repairs are paid.

  5. (7) Option extension

An additional option fee extends the unrestricted right to terminate to 5:00 p.m. on a new date; the parties choose whether it is credited to the price.

  6. (8) Waive the option

The buyer gives up the unrestricted right to terminate.

  7. (9) Buyer Approval date

A new date for the buyer's notice under the Third Party Financing Addendum.

  8. (10) Other

Other modifications – brokers and agents may not practice law; the form tells the parties to consult an attorney.

After the amendment is signed

  • Enter the date of final acceptance on the amendment.
  • Recount every deadline that depends on a changed date – a new closing date moves the 3rd-day-before-closing financing deadline.
  • Send the signed amendment to everyone: title, lender, both agents.
  • An option extension must be signed before the current option period ends.
