Alabama · Ala. Code §§35-10-8, 35-10-12–35-10-14Alabama foreclosure sale: three weeks of notice and the courthouse door
When an Alabama mortgage contains a power of sale, the power is part of the security and may be exercised by whoever becomes entitled to the debt, and the conveyance to the buyer at the sale – executed by the mortgagee, its agents or attorneys or the person conducting the sale – vests legal title in the buyer; probate judges index foreclosure deeds under the names in both the mortgage and the foreclosure deed (Ala. Code §35-10-12). Notice of the sale is published once a week for three successive weeks in a newspaper published in each county where the land lies, or in an adjoining county if none is published there, and gives the time, place and terms of the sale and a description of the property (§35-10-13; see also §35-10-8). The sale is held at the front or main door of the courthouse of the county where the land or a substantial part of it lies, between 11 a.m. and 4 p.m. on the designated day (§35-10-14).
