Wyoming · W.S. 1-21-1207–1209Wyoming tenant deposits when selling a rental: who owes the refund after closing
Wyoming doesn't set a transfer procedure for deposits on a sale, but it binds the holder of the owner's (or designated agent's) interest in the rental unit at the time the rental agreement ends by the deposit rules (W.S. 1-21-1209) – after closing, that's the buyer, so the seller's deposits are something to settle between the parties at closing. The rules the buyer inherits: when the agreement ends, the deposit may be applied to accrued rent, damage beyond reasonable wear and tear, cleaning to the starting condition and other contract costs; the balance, any prepaid rent and a written itemization with reasons are delivered or mailed within 30 days after termination or 15 days after receiving the renter's new address, whichever is later, extended by 30 days if there's damage (1-21-1208(a)). A separately identified utilities deposit follows its own timeline (1-21-1208(b)). An owner who unreasonably fails to comply can owe the full deposit and court costs (1-21-1208(c)). The rental agreement must also state whether any part of the deposit is nonrefundable, with written notice when it's taken (1-21-1207).
The rules
1. Who is bound (W.S. 1-21-1209)
The holder of the owner's interest when the agreement ends.
2. Refund (1-21-1208(a))
30 days, or 15 after the new address; +30 days for damage.
3. Penalty (1-21-1208(c))
Full deposit and court costs for unreasonable noncompliance.
4. Nonrefundable part (1-21-1207)
Stated in the agreement and in writing when taken.
What the TC can do
- Get the rent roll with each tenant's deposit and any nonrefundable portion.
- Make sure the contract says how the deposits are credited or transferred at closing.
- Give the buyer the leases and deposit records – the buyer will owe the refunds.
