Wyoming · W.S. §§34-1-142–34-1-144Wyoming statement of consideration: the buyer's sworn statement, required to record
Wyoming collects sale prices through a sworn statement that never becomes public. When a deed, contract or other document transferring legal or equitable title to real property is presented to the county clerk for recording, it must be accompanied by a statement under oath by the grantee – the buyer – or the buyer's agent, giving the names, addresses and contact information of grantor and grantee, the dates of transfer and sale, the legal description, the actual full amount paid or to be paid, the terms of sale and an estimate of the value of any non-real property included (W.S. §34-1-142(a)). No instrument transferring real property may be accepted for recording until the completed sworn statement is received, though failing to comply doesn't affect the instrument between the parties (§34-1-142(b)). Listed transfers may leave out the price, terms and personal-property value – corrective instruments, entity reorganizations, gifts of more than half the value, transfers between spouses or parent and child for nominal consideration, transfers to the same party, and tax or foreclosure sales, among others (§34-1-142(c)). The statements are used only as statistics for county sales-price ratios, and a single statement can't by itself be used to adjust an individual property's assessment (§34-1-142(d)). The statement is not a public record and is held confidential, except that it may be disclosed to a person reviewing or contesting their own property tax assessment (§34-1-142(e)). Willfully falsifying or publicly disclosing it without authority is a misdemeanor punishable by up to $750, six months in jail, or both (§34-1-144).
