Wyoming · W.S. 34-1-132, 34-1-146, 34-1-147Wyoming mortgage release: 30 days after a certified-mail request

In Wyoming, a mortgagee – the original mortgagee or, if assigned, the current holder or its servicing agent – must, within 30 days after receiving a written request for discharge by certified or registered mail, execute and acknowledge a certificate or deed of discharge or release, if the mortgage's condition has been fully performed and no other written agreement between the parties encumbers the property (W.S. 34-1-132(a), (d)). One that fails or refuses is liable for all actual damages plus special damages of one-tenth of one percent of the original principal for each day after the 30 days until the release, capped at $100 a day; the mortgagee of record stays liable despite an assignment unless, within 60 days after the request, it gives the requester the name and address of the current holder with authority to release (34-1-132(b)–(c)). A title insurer or title agent that paid the loan, or has satisfactory evidence it was paid in full, may release a mortgage or reconvey a trust deed: no sooner than 30 days after payoff and after the §34-1-132 notice, it sends a notice of intent with a copy of the release (34-1-146), and it may not record the release if the lender objects by certified mail within 30 days (34-1-147). The county clerk discharges the mortgage of record when the release is recorded (34-1-130).

After a certified or registered mail request.

  2. 2. Penalty (34-1-132(b))

Actual damages plus 0.10% of original principal a day, max $100 a day.

  3. 3. Assigned loans (34-1-132(c))

What the TC can do

  • Note the payoff date – the statutory clock runs from it or from the written request.
  • Calendar a check of the county records for the recorded release.
  • If it's missing, send the written request in the form the statute requires and keep proof of delivery.
