Wyoming · W.S. 29-2-101 et seq.Wyoming construction lien deadlines: preliminary notices, the 150/120-day filing and the 180-day suit
In Wyoming, a contractor must file its lien statement within 150 days, and every other claimant within 120 days, of the earlier of the last day work was performed or materials furnished, or substantial completion of the project; for a subcontractor, after the last day it worked at the contractor's direction (W.S. 29-2-106(a)). The record owner may record a notice of substantial completion, which is presumed to be the completion date, and must send a copy within five days to everyone who gave a preliminary notice (29-2-106(c)). Before filing, a claimant must send the record owner a notice of intention at least 20 days before filing the lien statement (29-2-107). Preliminary notices are a condition of the lien: the contractor sends the owner a notice of lien rights before receiving any payment, and subcontractors and suppliers within 30 days after first furnishing – missing them bars the lien (29-2-112). An action to foreclose must be started within 180 days after the lien statement is filed, or the lien ends (29-2-109).
