Utah · DeedsUtah deed recording: the notarial certificate, the tax mailing address, the caption and the fee
In Utah a certificate of acknowledgment, a proof of execution or a jurat signed and certified by the officer entitles a document to be recorded with the recorder of the county where the property lies (Utah Code §57-3-101). A document conveying title presented for recording after July 1, 2022, must name the grantees and recite a mailing address to be used for assessment and taxation, and must contain a legal description – by metes and bounds, a government survey, a lot or unit in a recorded plat, or another description the statute allows (§57-3-105). The recorder may refuse a document that isn't an original or an electronic document meeting the electronic recording act, that lacks a brief caption on page one stating its nature, or that isn't legible enough for certified copies (§57-3-106). The recorder charges $40 for recording an instrument, plus $2 for each description beyond 10; counties of the second through sixth class add $5 unless the county has a balance in its restricted recording-fee account, and only one fee is charged per instrument however many titles or attachments it has; fees must be paid before recording (Utah Code §17-71-407).
