Texas · TREC 9-18Texas unimproved property contract (TREC 9-18)
Land without buildings in Texas uses TREC 9-18, effective July 1, 2026. Most dates match the resale contract – earnest money and option fee within 3 days, the title commitment within 20 days. What differs: copies of natural resource leases (oil, gas, wind, water) within 3 days after the Effective Date with a termination window for the buyer, an in-contract seller's disclosure (flooding, floodplain, wetlands, endangered species, oak wilt), the Seller's Water Disclosure, and rollback taxes.
What is different from 20-19
Natural resource leases (¶4B)
Oil and gas, mineral, geothermal, water, wind or other leases the seller is party to. If the buyer has not received copies, the seller delivers them within 3 days after the Effective Date, and the buyer may terminate within the days written after receiving all of them – earnest money refunded.
Seller's disclosure (¶7E)
Checked in the contract: flooding with a material adverse effect, litigation, condemnation or special assessments, environmental hazards, dumpsites or underground tanks, wetlands, threatened or endangered species, floodplain, and oak wilt.
Water disclosure (¶7F)
The same Seller's Water Disclosure choice as ¶7I of 20-19 – received, delivered later with a 7-day termination right, or exempt.
Rollback taxes (¶13B)
If the sale or the buyer's use after closing triggers additional taxes for prior periods, the buyer pays; if caused by the seller's use or change of use before closing, the seller pays.
What stays the same
- Earnest money and option fee within 3 days after the Effective Date (¶5A).
- Title commitment within 20 days after the title company receives the contract; survey and objections (¶6).
- Notices, mediation, escrow and default paragraphs.
What the TC tracks
- The 3-day natural resource lease delivery and the buyer's termination window after receipt.
- The ¶7F water disclosure path – land deals often have wells, ponds or tanks.
- Agricultural valuation: who pays rollback taxes if the use changes.
- Mineral reservations in ¶2 and TREC 44-3.
