Texas · TREC 24-20Texas new home contract (TREC 24-20)
A completed new home in Texas is sold on TREC 24-20, effective July 1, 2026 (TREC 23-20 is for homes still under construction). The dates mostly follow the resale contract, but the builder makes no express warranties beyond the contract or a separate writing and assigns manufacturer warranties, the insulation must be disclosed as FTC rules require, agreed work must be done by licensed persons before closing – with up to a 5-day extension – and the seller's disclosure sits inside the contract.
What is different from 20-19
Warranties (¶7C)
Except as set out in the contract, a separate writing or by law, the seller makes no other express warranties; it assigns all assignable manufacturer warranties at closing.
Insulation (¶7D)
As Federal Trade Commission rules require: type, thickness and R-value of insulation in exterior walls, other walls, ceilings and other areas – or attached specifications.
Agreed work (¶7F)
Repairs, treatments and improvements completed before closing by licensed persons (or persons commercially engaged in the trade), with permits, receipts and transferable warranties. If not done, the buyer may use the default remedies or extend closing up to 5 days.
Seller's disclosure and taxes (¶7H, ¶13B)
The in-contract disclosure (flooding, litigation, environmental hazards, wetlands, floodplain, oak wilt…); rollback taxes caused by the seller's use before closing are the seller's.
