Texas · TREC 25-17Texas farm and ranch contract (TREC 25-17)

Rural Texas property described by metes and bounds is usually sold on TREC 25-17, effective July 1, 2026. It adds what land deals need: the seller may harvest growing crops until possession, the price can be adjusted per acre to the survey – with a termination right if it moves more than 10% – copies of natural resource and surface leases (grazing, hunting, wind, solar) are due within 3 days after the Effective Date, and pre-agreed exception documents and surface leases are not grounds for title objection.

What the farm and ranch form adds

  1. Crops (¶2D)

Unless agreed otherwise, the seller may harvest all growing crops until possession is delivered; retained crops are listed as exclusions.

  2. Acreage adjustment (¶3D)

If checked, the price is adjusted by the difference between the acres stated and the survey, at the per-acre amount written. If it changes by more than 10%, either party may terminate within the days written after receiving the survey.

  3. Leases in 3 days (¶4C–D)

Natural resource leases (oil, gas, mineral, geothermal, water) and surface leases (grazing, hunting, agricultural, recreational, wind, solar, timber): copies – and notice of oral surface leases – within 3 days after the Effective Date; the buyer may terminate within the days written after receiving them all.

  4. Title (¶6E–F)

Exception documents provided before signing, and the surface leases listed, are permitted exceptions – not grounds for objection.

What the TC tracks

  • The 3-day lease deliveries and each termination window that follows.
  • The survey date – it triggers the acreage adjustment and any 10% termination window.
  • Rollback taxes on agricultural valuation (¶13B).
  • The water disclosure and any mineral reservation – common on rural land.
  • Possession and crop harvest timing against the closing date.

Questions about the Texas farm and ranch contract

When is the TREC farm and ranch contract used?

Generally for rural property with a metes and bounds description from a survey; TREC 25-17 is effective July 1, 2026.

How does the acreage price adjustment work?

If checked, the price changes by the acreage difference times the per-acre amount; above a 10% change either party may terminate within the days written after receiving the survey.

When must the seller deliver grazing or hunting leases?

Copies of written surface leases and notice of oral ones within 3 days after the Effective Date, if not already provided.

Who keeps the crops in a Texas farm sale?

Unless agreed otherwise, the seller may harvest all growing crops until possession is delivered.

Is the farm and ranch contract different from the unimproved property contract?

Yes. TREC 9-18 is for lots and land without buildings; 25-17 adds crops, acreage adjustment, surface leases and exception documents for rural tracts.
