Texas · TREC 20-19 ¶11, ¶22, ¶23Texas contract addenda list and special provisions under TREC 20-19
Paragraph 22 of the TREC resale contract says the contract is the parties' entire agreement and can only be changed in writing, then lists the addenda and notices that become part of it, by checkbox. Financial: Third Party Financing, Sale of Other Property by Buyer, Right to Terminate Due to Lender's Appraisal, Seller Financing, Section 1031 Exchange, Short Sale, Loan Assumption, and Release of Liability on Assumed Loan / Restoration of Seller's VA Entitlement. Leases: Residential Leases, Fixture Leases, Buyer's and Seller's Temporary Residential Lease. Tests and reports: Hydrostatic Testing; Environmental Assessment, Threatened or Endangered Species and Wetlands. Statutory disclosures and notices: lead-based paint, propane gas system service area, property seaward of the Gulf Intracoastal Waterway, coastal area property, and utility, water, drainage and other district notices – and the contract warns that a seller's failure to provide them may give the buyer remedies or a right to terminate. Other: HOA mandatory membership, Non-Realty Items, Back-Up Contract, Reservation of Oil, Gas and Other Minerals. Paragraph 11 limits Special Provisions to informational items – completing a blank, disclosing facts or giving instructions – because agents may not practice law or change the contract's terms unless a party or a party's attorney drafted the change; paragraph 23 tells both sides to read carefully and consult an attorney.
