Oklahoma · O.S.Oklahoma real estate closing laws: a checklist for transaction coordinators
Oklahoma's rules for a home sale, in the order a transaction meets them: the seller delivers the statutory disclosure or disclaimer statement under the Residential Property Condition Disclosure Act; a wholesaler gives its written disclosures and the two-business-day cancellation notice (59 O.S. §858-314); a deed, mortgage or contract affecting the homestead needs both spouses' signatures (16 O.S. §4); a deed signed by an attorney-in-fact can't be recorded until the power of attorney is recorded in the same county office (16 O.S. §20); contractors have four months, and subcontractors 90 days, to file liens (42 O.S. §§142, 143); and after payoff the lender files the release within 30 days (46 O.S. §15). A transfer-on-death beneficiary records an affidavit with the death certificate within nine months of the owner's death (58 O.S. §1252).
