Oklahoma · 59 O.S. §§858-353–858-364Oklahoma broker duties disclosure and the deed-theft notice at closing

Every Oklahoma broker owes all parties duties that can't be waived: honesty and reasonable skill and care, receiving and presenting written offers, timely accounting for money and property, keeping specified information confidential, the property condition disclosures, and written disclosure of compensation and fees to the represented party before the contract's effective date (59 O.S. §858-353(A)). A broker describes and discloses those duties in writing before the party signs a contract to buy, sell, lease, option or exchange; a firm serving both sides notifies both in writing before they sign; and a broker providing fewer services discloses which steps it won't handle (§858-355.1(C)–(E)). Each party confirms these disclosures in writing in a separate provision in or attached to the contract, or the broker documents compliance if it didn't prepare the contract (§858-356). Since November 1, 2025, as part of each closing the broker gives the buyer a notification of the signs and risks of deed theft, and the buyer signs it (§858-364; deed theft is defined in §858-351).
