Oklahoma · TitleOklahoma adverse possession: the 15-year limit and the five-year sale-deed rules
Oklahoma lets actions to recover real property, or to determine an adverse right in it, be brought only within these periods after the cause of action accrues. Five years after the deed is recorded – or after the final judgment of partition in kind, or after the decree of distribution is recorded – for actions by the former owner, heirs or those claiming through them to recover land sold on execution, partitioned or sold in partition or another judicial sale, or distributed by a probate decree; five years after the deed is recorded for heirs or wards suing over land sold by executors, administrators or guardians under court order; and five years after the tax deed is recorded for land sold for taxes, except land exempt from taxation under federal law. These five-year rules apply even if the deed, judgment or underlying proceeding is void or voidable. Any other action to recover real property must be brought within fifteen years, and an action for forcible entry and detainer within two years (12 O.S. §93). A person under a legal disability when the cause of action accrues may sue within two years after the disability is removed (12 O.S. §94).
