Title · 3 statesManufactured homes affixed to land: affidavit, title surrender and liens

When a buyer is purchasing land with a manufactured home on it, the title company needs to know whether the home is still titled like a vehicle or has become part of the real estate. Arizona: an owner of a mobile home installed on land the owner owns may record an affidavit of affixture with the county recorder, listing the vehicle identification numbers, the legal description, prior tax information and any security interest not released, with the Department of Transportation's receipt for the surrendered title attached; the home is then assessed as real property from the next tax rolls, and a recorded affidavit doesn't impair a perfected security interest unless the secured party consents in it (A.R.S. §§42-15201–42-15204, 28-2063(A)(3)). Alabama: when the home is permanently affixed and owned by the same person as the land, the owner or lienholder applies through a designated agent for a certificate of cancellation of the certificate of origin or title, delivering the title, the lien release (or a bond) and an affidavit of all owners with the probate judge's verification that the home is recorded as real property; a home later detached must be retitled (Ala. Code §§32-20-20, 32-20-21). Oklahoma: the title of a permanently affixed manufactured home may be surrendered to Service Oklahoma or a licensed operator for cancellation with a $5 fee and the legal description; it isn't cancelled while a lien is registered or recorded, and the assessor is notified (47 O.S. §1110(E)).

How each state retires the title

  1. Arizona (A.R.S. §§42-15203, 28-2063)

Affidavit of affixture recorded; title surrendered to ADOT; assessed as real property; liens survive without consent.

  2. Alabama (Ala. Code §32-20-20)

Certificate of cancellation from the Department of Revenue; title, lien release and owners' affidavit with probate verification.

  3. Oklahoma (47 O.S. §1110(E))

Title surrendered to Service Oklahoma, $5; not cancelled while a lien is recorded; assessor notified.

What the TC does on a property with a manufactured home

  • Ask the seller for the home's title or the recorded affidavit or cancellation, and send it to the title company.
  • Ask the title company whether any lien on the home is still recorded or noted on its title.
  • If the title hasn't been retired, ask the lender and the title company what they need before closing.
