Kentucky · Manufactured homesKentucky manufactured homes: the affidavit of conversion and the title surrender

When a manufactured home is or will be permanently affixed to real estate in Kentucky, the owner may file an affidavit of conversion to real estate with the clerk of the county where the land lies, attesting that the home has been or will be permanently affixed, together with the surrender of the Kentucky certificate of title; the clerk files it in the miscellaneous record book. The clerk may not accept a surrendered title that shows an unreleased lien unless it comes with a release of the lien or with an affidavit, signed under oath by the Kentucky-licensed attorney who satisfied the liens, that every lien noted on the title has been paid; that affidavit doesn't excuse the lender from filing its release. The clerk sends a copy of the affidavit to the property valuation administrator for the county's real property tax rolls, and filing the affidavit and surrendering the title is deemed to convert the home into an improvement to the land it sits on. An inaccurate or fraudulent affidavit makes the title surrender void (KRS 186A.297).

What the statute sets

  1. Filing (KRS 186A.297(1))

Affidavit of conversion with the county clerk plus the surrendered certificate of title.

  2. Liens (KRS 186A.297(2)–(3))

Release of the lien, or a Kentucky attorney's sworn affidavit that the liens were paid; the lender still files its release.

  3. Effect (KRS 186A.297(7))

Copy to the property valuation administrator; the home becomes an improvement to the land.

  4. False affidavit (KRS 186A.297(5))

    The title surrender becomes void.

What the TC does when a Kentucky sale includes a manufactured home

  • Ask the title company whether an affidavit of conversion was filed and the title surrendered.
  • If not, ask how it wants the home handled – conversion before closing or a separate title transfer.
  • Get the lien release for any lien noted on the home's certificate of title.

Questions about Kentucky manufactured home conversion

Not with an unreleased lien noted on it, unless the lien release or a Kentucky attorney's sworn affidavit that the liens were paid comes with it (KRS 186A.297(2)).
