Escrow · 12 CFR 1024.34(b)Escrow refund after a sale or refinance: when the money comes back
The tax and insurance money in a mortgage escrow account is not part of the payoff. Once the loan is paid in full – at a sale or a refinance – the servicer must return any amount left in the escrow account within 20 days, excluding Saturdays, Sundays and legal public holidays (12 CFR 1024.34(b)(1)). The one exception: if the borrower agrees, the servicer may instead credit the balance to the escrow account of a new loan at its settlement, when the new loan comes from the same original lender, the owner or assignee of the old loan, or uses the same servicer (§1024.34(b)(2)). So a seller usually gets an escrow refund check a few weeks after closing, separate from the sale proceeds.
What Regulation X says
Deadline
Within 20 days after the loan is paid in full, excluding weekends and legal public holidays (§1024.34(b)(1)).
What is returned
Any amount remaining in an escrow account within the servicer's control.
Exception
With the borrower's agreement, credited to the new loan's escrow if the same lender, owner or servicer is involved (§1024.34(b)(2)).
Separate from proceeds
The refund comes from the old servicer, not from the title or escrow company's settlement.
What the seller should do
- Make sure the servicer has the forwarding address – the refund is usually mailed.
- Count 20 business days from the payoff, not from the closing appointment.
- If nothing arrives, send the servicer a written request for information about the escrow balance.
What the TC can tell the client
- Do not count the escrow balance as cash at closing – the payoff statement usually leaves it out.
- Expect the refund separately after closing; keep homeowner's insurance until the sale funds.
- Cancel the old insurance after closing; a refund of unused premium comes from the insurer, not the servicer.
Questions sellers ask
How long does it take to get my escrow refund after selling my house?
The servicer must return the remaining escrow balance within 20 days after the loan is paid in full, not counting weekends and legal public holidays (12 CFR 1024.34(b)(1)).
Does the escrow balance reduce my payoff?
Usually not: the payoff is the loan balance, and the escrow balance is refunded separately after the loan is paid.
What happens to escrow when I refinance with the same lender?
With your agreement, the servicer may move it to the new loan's escrow account at settlement if the same lender, owner or servicer is involved (§1024.34(b)(2)).
