Refinance · 12 CFR 1026.23Right of rescission: the three-day cancel window on a refinance
When a loan puts a lien on your principal home – a refinance with a new lender, a home equity loan or a HELOC – each owner whose interest is pledged can cancel until midnight of the third business day after the latest of signing, receiving the rescission notice and receiving the required disclosures (12 CFR 1026.23(a)). That is why funds on a refinance are not released at signing. A loan to buy or build the home is exempt, and a refinance with the same lender is rescindable only for new money beyond the old balance and the refinancing costs (§1026.23(f)). After you rescind, the lien is void and the lender must return all money within 20 calendar days (§1026.23(d)). If the notice or disclosures were never given, the right lasts up to three years (§1026.23(a)(3)). It can be waived only for a bona fide personal financial emergency, by a dated written statement in the borrower's own words – printed forms are prohibited (§1026.23(e)).
How the right works
Which loans
Credit secured by the consumer's principal dwelling – refinances, home equity loans, HELOCs (§1026.23(a)(1)).
Not covered
Loans to buy or build the home; same-lender refinances except new money; loans from a state agency (§1026.23(f)).
Deadline
Midnight of the third business day after the last of signing, the notice and the material disclosures (§1026.23(a)(3)(i)).
Example
Signed with all documents on Friday June 1 → right ends at midnight Tuesday June 5 (official interpretation).
After rescission
Lien void; no finance charge owed; lender returns money within 20 calendar days (§1026.23(d)).
Missing notice
Right extends up to 3 years after signing, or until transfer or sale (§1026.23(a)(3)(i)).
How to rescind
- Use the notice of right to cancel given at closing; every owner whose interest is pledged has the right.
- Mail it or deliver it to the lender's place of business before the deadline, or use another method the notice allows.
- Keep proof of when it was sent – mailing on time is enough.
What the closing team plans for
- Funding and payoff dates three business days after signing on a refinance.
- Signatures from every owner, including a non-borrowing spouse who owns the home.
- No disbursement before the rescission period ends.
