Colorado · Real Estate Commission formsColorado closing rules: a checklist for transaction coordinators

In Colorado most of the closing rules a TC tracks come from the Real Estate Commission's forms, mandatory from January 1, 2026. The CBS1 residential contract puts every date in one table in §3.1; a day ends at 11:59 p.m. Mountain Time unless a time of day is written, the first day is excluded, and a weekend or holiday deadline moves only if the box says so; a blank or N/A deadline deletes that provision. The seller – not the broker – completes the SPD19 Seller's Property Disclosure and delivers it by the deadline in the contract, and a new adverse material fact after the contract lets the buyer terminate by the earlier of closing or five days after receiving it (CBS1 §§10.1–10.2). A party ends the contract with a written Notice to Terminate the other side receives by the deadline – a late notice is ineffective – and on termination the earnest money is returned to the buyer, subject to the dispute rules (CBS1 §§23–24).

The forms and their deadlines

  1. 1. Deadline table (CBS1 §3.1)

11:59 p.m. Mountain Time; first day excluded.

  2. 2. Seller's disclosure (SPD19; CBS1 §10.1)

Completed by the seller, by the contract deadline.

  3. 3. Notice to Terminate (CBS1 §24)

Must be received by the deadline; late is ineffective.
