Alaska · AS 34.20.050, 34.20.115Alaska mortgage release and reconveyance: 10 days, $300, and the title company's 90-day route
In Alaska, if a mortgagee – or its personal representatives, successors or assigns – after full performance of the mortgage's condition neglects or refuses, for 10 days after a written request and tender of the reasonable charges, to discharge the mortgage or to execute and acknowledge a certificate of discharge or release, it is liable to the mortgagor, heirs, successors or assigns for $300 in damages plus all damages caused by the neglect or refusal (AS 34.20.050); the certificate and its acknowledgment are recorded in full (AS 34.20.040). For a deed of trust, unless the beneficiary itself has asked the title insurance company to reconvey, the title insurer – not less than 30 days after the debt is paid in full and it has satisfactory evidence of payment – mails by certified mail or hand-delivers a notice of intent to reconvey to the beneficiary and the servicer, with a copy of the reconveyance; after at least 90 days without an objection, it may execute and record the acknowledged reconveyance (AS 34.20.115(a)–(e)).
The rules

What the TC can do

- If it's missing, send the written request in the form the statute requires and keep proof of delivery.
