Alaska · HOAAlaska HOA and condo liens: automatic from the due date, six months ahead of the first mortgage

Under Alaska's Common Interest Ownership Act, the association has a lien on a unit for any assessment levied against it or fines imposed on its owner from the time the assessment or fine becomes due (AS 34.08.470(a)). Recording the declaration is record notice and perfection of the lien, and no further claim of lien has to be recorded (§34.08.470(d)). The lien is prior to other liens except those recorded before the declaration, a first security interest recorded before the assessment became delinquent, and real estate taxes; but it is also prior to that first security interest for the common expense assessments under the periodic budget that would have become due in the six months before an action to enforce the lien (§34.08.470(b)). The lien is extinguished unless proceedings to enforce it start within three years after the full amount becomes due (§34.08.470(e)). On written request the association must furnish a statement of unpaid assessments within 10 business days, recordable if the unit is real estate and binding on the association (§34.08.470(h)).
