Closing Disclosure 3-day rule calculator
Enter the closing date. You get the last day the borrower must receive the Closing Disclosure – and the last day to send it if it is not handed over in person.
How the 3-day rule works
3 business days before closing
The borrower must receive the Closing Disclosure no later than three business days before consummation (12 CFR 1026.19(f)(1)(ii)).
What a business day is here
Every calendar day except Sundays and the federal legal public holidays – so Saturdays count.
Holidays on their actual date
The holiday itself is skipped. If it falls on a Saturday, the Friday some offices observe is still a business day.
Mail and email
If it is not handed over in person, the borrower is considered to receive it 3 business days after it is delivered or placed in the mail.
Changes that restart the 3-day wait
- The APR becomes inaccurate beyond the allowed tolerance.
- The loan product changes.
- A prepayment penalty is added.
Other changes
Other changes need a corrected Closing Disclosure that the borrower receives at or before closing, without a new 3-day wait. The borrower may also ask to see it during the business day before closing.
What the TC does with it
- Put the receive-by date on the timeline the day the closing date is set.
- Ask the lender when the Closing Disclosure will be sent, and confirm the borrower received it.
- Watch for rate, product or prepayment changes late in the file – they move the closing.
- Send the wire-fraud warning with the closing instructions.
Questions about the Closing Disclosure 3-day rule
What is the Closing Disclosure 3-day rule?
The lender must make sure the borrower receives the Closing Disclosure at least three business days before closing, so there is time to review the final loan terms and costs.
Does Saturday count as a business day for the Closing Disclosure?
Yes. For this rule a business day is every day except Sundays and federal legal public holidays.
If closing is on Thursday, when must the borrower receive the Closing Disclosure?
By Monday – Monday, Tuesday and Wednesday are the three business days before Thursday, if none is a federal holiday.
Does an emailed Closing Disclosure count the same day?
Not automatically: unless the lender can show earlier receipt, a Closing Disclosure not delivered in person is considered received three business days after it is sent.
Does the 3-day rule apply to cash purchases?
No. It applies to consumer mortgage loans covered by the rule; a cash buyer gets a settlement statement instead.
