Wyoming · TitleWyoming quiet title: the possessor's action and the 40-year marketable record title
Wyoming lets a person in possession of real property, personally or through a tenant, bring an action against anyone claiming an adverse estate or interest, to determine that interest (W.S. 1-32-201). Separately, the Marketable Title Act gives a person with an unbroken record chain of title to an interest for forty years or more a marketable record title (34-10-103), counted from the root of title, the most recent recorded conveyance as of a date forty years before marketability is determined (34-10-101(a)(v)). That title is held free of all interests and claims depending on any act or event before the root of title (34-10-105), except interests inherent in the chain, interests preserved by a verified notice recorded during the forty years or by forty years of continuous possession, rights from adverse possession after the root, and later recorded transactions (34-10-104, 34-10-106). A person who files such a notice only to slander title pays the plaintiff's costs and damages in a quiet title action (34-10-109).

What the TC does when a Wyoming title commitment shows an old claim
- Ask the title company whether the claim predates the 40-year root of title.
- Check for a verified preservation notice recorded during the 40 years.
- If the claim survives, route the quiet title question to the attorneys and set the closing date after the judgment.
