Wyoming · ForeclosureWyoming foreclosure by advertisement: the notice of intent, four weeks' publication and the courthouse sale
Wyoming mortgages with a power of sale can be foreclosed by advertisement. To do so there must be a default that makes the power of sale operative, no pending suit to recover the debt (or one discontinued or returned unsatisfied), a recorded mortgage and recorded assignments, and a written notice of intent to foreclose by advertisement and sale sent by certified mail, return receipt, to the record owner and any different person in possession at least ten days before publication of the notice of sale begins (W.S. 34-4-103(a)). The notice of sale is published once a week for four consecutive weeks in a newspaper printed in the county, and before the first publication a copy goes by certified mail to the record owner, the person in possession and all holders of subordinate recorded mortgages and liens of record at least 25 days before the sale (W.S. 34-4-104(a)). The notice names the parties, the mortgage and its recording, the amount claimed, the property, the time and place of sale, and warns that other liens may survive (W.S. 34-4-105). The sale is a public auction to the highest bidder between 10 a.m. and 5 p.m. at the courthouse door or where district court is held, and it's void if the foreclosing party isn't present or hasn't waived appearance (W.S. 34-4-106).
