Washington · ForeclosureWashington trustee's sale: notice, the eleventh-day cure deadline, the Friday sale and no redemption

Under a Washington deed of trust, the trustee must record the notice of sale with the county auditor and mail it to the borrower, grantor and junior interest holders at least 90 days before the sale, or 120 days when the pre-foreclosure letter under RCW 61.24.031 is required, and post it on the property or serve it on an occupant. The sale is held at a public place in the county on a Friday, or the following Monday if Friday is a holiday, and the trustee may continue it for up to 120 days in total (RCW 61.24.040). Until the eleventh day before the sale, the borrower, grantor, a guarantor or a junior lienholder can stop it by curing the default and paying the trustee's fees and costs (RCW 61.24.090). Once the trustee accepts a bid the sale is final if the trustee's deed is recorded within 15 days, and after a trustee's sale no one has a right to redeem (RCW 61.24.050). No deficiency judgment may be taken against the borrower or grantor after a trustee's sale, apart from limited commercial-loan exceptions (RCW 61.24.100). A court can restrain the sale on proper grounds, on condition that the applicant pays the periodic payments into court (RCW 61.24.130).
