Washington · RCW 64.06.030Washington seller disclosure statement (Form 17): the 5- and 3-business-day rules

In Washington the seller of residential property delivers the completed, signed seller disclosure statement – commonly called Form 17 – within 5 business days after mutual acceptance, unless the parties agree otherwise (RCW 64.06.030). The buyer then has 3 business days to approve it or rescind the purchase agreement in its sole discretion by written notice, with deposits returned. If no rescission arrives in time, the statement is deemed accepted.

The rules

  1. 5 business days (RCW 64.06.030)

A completed, signed and dated disclosure statement no later than five business days after mutual acceptance, or as otherwise agreed.

  2. 3 business days to decide

Within three business days of receipt (or as agreed) the buyer approves the statement or rescinds the agreement in its sole discretion by written notice – deposits and other consideration returned, less agreed disbursements. Silence means approval.

  3. Waiver (RCW 64.06.010(7))

The buyer may expressly waive receipt – but not the Environmental section if any of its answers would be yes.

  4. Liability (RCW 64.06.050, .070)

No liability for errors the seller or licensee did not actually know of, or that came from public agencies or licensed experts; the chapter adds no remedy beyond the rescission right.

Good to know

  • Exempt: foreclosures and deeds in lieu, gifts and transfers to close family, divorce transfers, buyers who owned an interest within two years, less-than-fee interests, personal representatives and bankruptcy trustees (RCW 64.06.010).
  • Separate statutory formats exist for unimproved residential land and commercial property (RCW 64.06.013, .015).
  • A revised version of RCW 64.06.020 – the improved residential form – takes effect January 1, 2027.

What the TC tracks

  • Mutual acceptance + 5 business days – the seller's delivery deadline (or the agreed date).
  • Receipt + 3 business days – the buyer's decision window.
  • Any waiver, and whether the Environmental section still has to be delivered.
  • The correct form version for contracts entered from January 1, 2027.
