Virginia · Va. Code §§47.1-2, 47.1-13Virginia remote online notarization: the electronic notary, the identity methods and Virginia law
Virginia defines remote online notarization as an electronic notarization where the signer isn't in the physical presence of the notary, performed by an electronic notary – a notary the Secretary of the Commonwealth has commissioned with the capability of performing electronic notarial acts (Va. Code §47.1-2). For an electronic notarization, satisfactory evidence of identity may be based on video and audio conference technology meeting the standards in §19.2-3.1, confirmed by personal knowledge, by a credible witness who personally knows the signer, or by at least two of these: credential analysis of an unexpired government photo ID with signature, antecedent in-person identity proofing to federal standards, another identity proofing method authorized under §2.2-436, a valid digital certificate accessed by biometrics or a PIV card, or a knowledge-based authentication assessment (§47.1-2). The electronic notarial certificate must indicate whether the notarization was done in person or by remote online notarization (§47.1-2). A Virginia notary may perform notarial acts outside the Commonwealth when they're performed under the chapter, and an electronic notarial act performed under the chapter is deemed performed in Virginia and governed by Virginia law (§47.1-13(B), (D)).
