Virginia · TitleVirginia quiet title: removing a cloud on title with equitable title or without possession
A cloud on title – an old deed of trust that was never released, a deed with a defect, a claim by someone who no longer has a real interest – can block a sale until the title company is satisfied it no longer matters. In Virginia the remedy is a petition to remove the cloud on title to the real estate. When such a petition is filed, relief can't be denied because the complainant has only an equitable title to the real estate and is out of possession: the court must grant the complainant the relief it would be entitled to if it held the legal title and was in possession. If an issue of fact is raised that would otherwise entitle either party to a jury trial, the court must order that issue tried by a jury at the request of the party entitled to it (Va. Code §55.1-123). For an old deed of trust, Virginia separately limits enforcement to ten years after the last obligation it secures became due, unless a certificate extending it was recorded (§8.01-241).
What the statute sets
Petition (§55.1-123)
A petition to remove a cloud on the title to real estate.
Equitable title (§55.1-123)
Relief isn't denied because the complainant holds only equitable title.
Possession (§55.1-123)
Being out of possession doesn't bar relief; the court acts as if the complainant held legal title and possession.
Jury (§55.1-123)
Issues of fact go to a jury on the request of a party entitled to one.
What the TC does when Virginia title shows a cloud
- Ask the title company exactly what it needs to insure over or remove the item.
- If a release or quitclaim can't be obtained, track the seller's petition as a task with its hearing dates.
- Check whether an old deed of trust is past Virginia's ten-year enforcement limit.
Questions about Virginia quiet title
Does a Virginia complainant need legal title and possession to remove a cloud on title?
No. A complainant with only equitable title who is out of possession isn't denied relief for that reason; the court grants the relief a legal owner in possession would get (Va. Code §55.1-123).
Is there a jury in a Virginia action to remove a cloud on title?
Yes, on an issue of fact that would otherwise entitle a party to a jury, if that party requests it (Va. Code §55.1-123).
