Texas · TREC 30-18Texas condo contract (TREC 30-18): documents and resale certificate
A Texas condominium resale uses its own contract – TREC 30-18, effective July 1, 2026 – not the one-to-four family form. Its key extra deadlines: the seller delivers the condominium documents (declaration, bylaws, rules) and the association's resale certificate within the days written, and the buyer may terminate within 7 days after receiving each of them, with the earnest money refunded. The buyer keeps the rights of Texas Property Code §82.156.
What is different for a condo
Documents (¶2B)
The declaration, bylaws and rules. If the buyer has not received them, the seller delivers them at its expense within the days written; the buyer may terminate within 7 days after receiving them – earnest money refunded.
Resale Certificate (¶2C)
From the condominium owners association, in a TREC-promulgated or agreed form, with at least the information of Property Code §82.157, prepared at the seller's expense no more than 3 months before delivery. If not yet received, the seller delivers it within the days written; the buyer may terminate within 7 days after receiving it.
Seller's affidavit option
If the seller asked the association for its financial information and none was provided, the parties may waive the certificate based on the seller's affidavit.
Right of refusal (¶2D)
If the documents give the association or a member a right of refusal, the Effective Date moves to the date the buyer receives the association's certification that it was complied with or waived; if it does not arrive within the days written or the right is exercised, the contract terminates and the earnest money is refunded.
What the TC tracks
- Use TREC 30-18 for condominium units – not the 20-19 resale contract.
- Delivery dates of the documents and the resale certificate – each starts its own 7-day window.
- That the certificate is no more than 3 months old when delivered.
- Any right of refusal – it can move the Effective Date and every deadline counted from it.
