South Dakota · TitleSouth Dakota quiet title: suing record claimants, heirs and unknown persons

South Dakota's quiet title action reaches the whole chain of title. An action may be maintained by any person having or claiming an estate or interest in, or a lien or encumbrance on, real property – in or out of possession, and whether the property is vacant or occupied – against anyone claiming an adverse estate, interest, lien or encumbrance; against all persons who appear from the records of the register of deeds, county treasurer, clerk of courts or other public records of the county to have or ever to have had an interest, lien or encumbrance; against the personal representatives, heirs, devisees, legatees and creditors of any of them who have died, known or unknown; and generally against all unknown persons who may claim an interest, to quiet title and determine those interests. Co-owners may join as plaintiffs where the relief demanded is common to all (SDCL 21-41-1), and several tracts anywhere in the state may be joined in one action if the plaintiffs share a common interest in the relief for all of them (SDCL 21-41-2).

What the TC does when South Dakota title shows a cloud

  • Ask the title company exactly what it needs to insure over or remove the item.
  • Try a release, quitclaim or satisfaction from the claimant first – it is faster than a lawsuit.
  • If a quiet title action is needed, track it and its hearing dates as tasks and keep the closing date flexible.
