South Dakota · LiensSouth Dakota judgment liens: docketing, the homestead exception and renewal
In South Dakota a judgment docketed with a clerk of the circuit court is a lien on all real property of the judgment debtor in that county, except the homestead – property owned when it is docketed and property acquired later – for ten years from docketing in the county where it was rendered; it doesn't become a lien on land in a county unless docketed there (SDCL 15-16-7). A money judgment may be renewed by affidavit of the judgment creditor or its representative at any time before ten years from its first docketing expire, setting out the parties, the court, the original judgment and the owner of the judgment (SDCL 15-16-33). Entry and docketing of the renewal affidavit continue the lien, to the extent of the balance shown in the affidavit, on the debtor's real property in that county except the homestead, for ten years from docketing of the affidavit (SDCL 15-16-35).

What the TC does when a South Dakota title search shows a judgment
- Confirm the judgment is against the seller and not someone with a similar name – the title company may accept an affidavit.
- Request a payoff and a satisfaction or release, and list the payoff on the settlement statement.
- Check the entry date and any renewal under South Dakota law.
