North Dakota · Century Code §47-10-02.3North Dakota HOA disclosure: 10 days to deliver, 5 days for the buyer

When a North Dakota home is subject to a homeowners' association or condominium, the seller must give the buyer, by an agreed date or within 10 days after the purchase agreement, a written package: dues and anything unpaid, approved special assessments, bylaws, rules and the declaration, minutes of the last two meetings, reserves and whether a reserve study is used, operating and reserve budgets and year-to-date financials, insurance, unsatisfied judgments and pending suits, alleged violations on the unit, transfer fees, collection remedies and policy, leasing restrictions, amenities and contact information (Century Code §47-10-02.3(2)). The association must furnish the documents within 10 days of the seller's request and may charge a reasonable fee disclosed before final acceptance (§47-10-02.3(5)). The buyer is not liable for unpaid amounts above those in the documents, and the contract is voidable by the buyer until the documents are provided and for five days after, or until conveyance.
