North Dakota · ForeclosureNorth Dakota foreclosure: the pre-foreclosure notice and the sixty-day redemption

North Dakota forecloses mortgages by action, after a warning. At least thirty and not more than ninety days before any action or proceeding to foreclose a mortgage on real estate is commenced, a written notice must be served on the title owner of record (N.D.C.C. §32-19-20). After the sheriff's sale, a party to the foreclosure or a party's successor may redeem within sixty days, except for abandoned property and agricultural land (§32-19-18). Agricultural land may be redeemed within 365 days after the summons and complaint are filed with the clerk or the notice by advertisement is first published, but the final date can't be earlier than sixty days after the sale (§32-19-18). The owner has the paramount right to redeem by paying the sheriff's sale bid plus interest at the mortgage rate, and subordinate lienholders may redeem in order of priority (§32-19-18). Outside mortgage foreclosures, the redemption period after a sheriff's execution sale is one year (§28-24-02).

  • Put the sheriff's sale date and the 60-day redemption deadline on the timeline.
