New Hampshire · RSA 477:4New Hampshire seller disclosure requirements
New Hampshire has no single disclosure form in statute; instead RSA 477 lists specific notices, each acknowledged by the buyer's signature. Before the contract, the buyer gets the radon, arsenic, lead, PFAS and flood notification (RSA 477:4-a). Before or while the offer is prepared, the seller of a one-to-four family home discloses private water and sewage systems, insulation, flood zone status and any residential heating oil underground tank (RSA 477:4-d), plus condo, methamphetamine and energy-tariff notices where they apply.
The notices
Radon, arsenic, lead, PFAS, flood (477:4-a)
Statutory text before the contract for any property with a building: testing for radon, arsenic, lead and PFAS, and flood insurance and FEMA maps. The buyer signs a copy; missing it does not affect title or create seller liability.
Water, septic, insulation, flood, oil tank (477:4-d)
Before or during preparation of an offer on a one-to-four family dwelling: private water supply (tests, problems), private sewage system (service, contractor), insulation type and location, federally designated flood hazard zone, and a residential heating oil underground storage tank – unknown items stated in writing.
Condominiums (477:4-f)
Before or during the offer, written notice that the buyer may obtain from the association the declaration, bylaws, rules, monthly and annual fees and special assessments of the last 3 years.
Methamphetamine and energy tariffs (477:4-g, 4-h)
Known methamphetamine production before cleanup is certified; and utility tariff charges for financed energy-efficiency or renewable improvements, with remaining term and amount if known.
Good to know
- For any property that includes a building, private water and sewage information is also due before the contract (477:4-c), including approved seating capacity for food service establishments.
- A homicide, other felony or suicide on the property need not be disclosed unless the buyer asks and the owner or agent knows (477:4-e).
- Each notice is acknowledged by the buyer signing a copy.
What the TC tracks
- The signed 477:4-a notice before the purchase and sale agreement.
- The 477:4-d disclosures with the offer – including the oil tank and flood zone answers.
- Condo association notice and any energy-tariff disclosure where applicable.
