Mortgage application · Regulation Z and XWhat the lender must send within three business days of a mortgage application

For most home loans, an application exists as soon as the lender has six pieces of information: the buyer's name, income, Social Security number to pull credit, the property address, an estimate of the property's value and the loan amount sought (12 CFR 1026.2(a)(3)(ii)). From then, the lender must deliver or mail three things no later than the third business day: the Loan Estimate (§1026.19(e)(1)(iii)(A)); for a purchase, the special information booklet – Your Home Loan Toolkit (§1026.19(g)); and a written list of homeownership counseling organizations near the buyer, taken from the CFPB's data no more than 30 days earlier (12 CFR 1024.20). A Loan Estimate that is mailed counts as received three business days later, and it must be delivered or mailed at least seven business days before closing (§1026.19(e)(1)(iii)(B), (iv)).

The six pieces that make an application (§1026.2(a)(3)(ii))

  1. Name

    The consumer's name.

  2. Income

    The consumer's income.

  3. SSN

The Social Security number, to obtain a credit report.

  4. Address

The property address – a buyer still shopping has no application yet.

  5. Value

An estimate of the property's value.

  6. Loan amount

    The mortgage loan amount sought.

The clock after the application

  1. Business day 3

    Loan Estimate

Delivered or placed in the mail (§1026.19(e)(1)(iii)(A)).

  2. Business day 3

    Your Home Loan Toolkit

For a purchase; not for refinances, subordinate liens or reverse mortgages; a mortgage broker may give it instead (§1026.19(g)).

  3. Business day 3

    Counseling list

Written list of homeownership counseling organizations for the applicant's location (§1024.20(a)(1)); not needed if the application is denied or withdrawn first.

  4. +3 business days

    Mailed = received

A Loan Estimate not given in person counts as received three business days after delivery or mailing (§1026.19(e)(1)(iv)).

  5. 7 business days before closing

Last day for the Loan Estimate

It must be delivered or mailed at least seven business days before consummation (§1026.19(e)(1)(iii)(B)).

What the TC does with this

  • Ask the buyer's lender for the application date – it starts these clocks and the financing timeline.
  • Note when the Loan Estimate went out; a late one can push closing because of the seven-business-day rule.
  • Keep the Loan Estimate on the deal to compare with the Closing Disclosure later.
