Minnesota · TitleMinnesota old mortgages: the 15-year foreclosure limit

No action or proceeding to foreclose a Minnesota real estate mortgage, whether by action, by advertisement or otherwise, can be maintained unless it is commenced within 15 years from the maturity of the whole debt the mortgage secures. The period runs from the date of the mortgage unless the mortgage clearly states the maturity date. It isn't extended by any party's nonresidence or disability, by payments made after maturity, or by an extension of the time of payment – unless the extension is in writing and recorded in the same office as the mortgage within the limitation period or before an earlier recorded extension expires. A foreclosure started in time may be completed even after the period ends, and a foreclosure by advertisement begins on the date of the first publication of the notice of sale (Minn. Stat. §541.03).

What the statute sets

  1. Limit (§541.03, subd. 1)

No foreclosure begun more than 15 years after the whole debt matured.

  2. Start date (§541.03, subd. 2)

The mortgage date, unless the maturity is clearly stated.

  3. Extensions (§541.03, subd. 1)

Only a written extension recorded in time; payments don't count.

  4. Advertisement (§541.03, subd. 2)

Begins at the first publication of the notice of sale.

What the TC does with an old mortgage on a Minnesota title

  • Ask the title company for the old mortgage's maturity date and any recorded extension.
  • Ask whether the title company treats the lien as expired under the statute.
  • If it doesn't, get a payoff or a release from the holder or its successor before closing.

Questions about old Minnesota mortgages

How long can a Minnesota mortgage be foreclosed?

Only within 15 years from the maturity of the whole debt, or from the mortgage date if the maturity isn't clearly stated (Minn. Stat. §541.03).

Do later payments extend the Minnesota limit?

No. Payments made after maturity don't extend it; only a written extension recorded in time does (Minn. Stat. §541.03, subd. 1).
