Michigan · MCL 565.954Michigan Seller Disclosure Statement: the 72- and 120-hour rule

In Michigan the seller of a one-to-four unit home delivers the seller disclosure statement before signing a binding purchase agreement (MCL 565.954). If the statement – or an amendment – is delivered after the agreement is signed, the buyer may terminate by written notice to the seller or seller's agent within 72 hours after delivery in person, or 120 hours after delivery by registered mail. The right ends when the property is transferred by deed or installment contract.

The rules

  1. Which transfers (565.952)

Any interest in real estate of one to four residential units – sale, exchange, installment land contract, lease-option or other option, ground lease with improvements – and transfers of residential cooperative interests.

  2. When (565.954(1))

For a sale, before the seller signs a binding purchase agreement. A statement given to the buyer's agent counts as given to the buyer.

  3. Late delivery (565.954(3))

Written notice of termination to the seller or seller's agent within 72 hours after delivery in person, or 120 hours after delivery by registered mail.

  4. End of the right (565.954(4))

The right to terminate expires when the property is transferred by deed or installment sales contract.

Exempt transfers (565.953, selection)

  • Court-ordered transfers, foreclosures, deeds in lieu and transfers to lenders in default.
  • Transfers by a nonoccupant fiduciary of an estate, guardianship, conservatorship or trust.
  • Co-tenant to co-tenant; to a spouse, parent, grandparent, child or grandchild; between spouses in a divorce.

What the TC tracks

  • The statement signed before the purchase agreement – compliance is noted on the agreement or an addendum.
  • If late: the delivery method and exact time – the window is counted in hours, not days.
  • Amendments delivered after signing – each opens a new window.
