Maine · ForeclosureMaine foreclosure: the 90-day redemption period and the public sale that follows
Maine forecloses by civil action, and redemption comes before the sale. If the court finds a breach, it issues a judgment of foreclosure and sale providing that, if the mortgagor or successors don't pay the adjudged sum with interest within the period of redemption, the mortgagee proceeds with a sale; if they do pay, the mortgagee must discharge the mortgage and dismiss the action (14 M.R.S. §6322). The period of redemption is 90 days from the judgment for mortgages executed on or after October 1, 1975, and one year for earlier mortgages unless the mortgage says otherwise, running from entry of judgment if no appeal is taken (§6322). When the period expires unredeemed, the mortgagor's remaining rights to possession end; the mortgagee publishes notice of a public sale once in each of 3 successive weeks, the first publication within 90 days after the period expires, and the sale is held 30 to 45 days after the first publication (§6323(1)). The mortgagee may still allow redemption or reinstatement before the sale, and the sale deed conveys the premises free and clear of the interests of the parties joined in the action (§6323(1)).

What the TC does when a Maine listing is in foreclosure
- Get the judgment date and count the 90-day redemption period on the timeline.
- Order the payoff early – a sale that closes inside the redemption period redeems the property.
- After the period ends, track the published sale date and any lender consent to redeem.
