Kentucky · KRS 324.360Kentucky seller's disclosure of conditions form

In Kentucky, when a real estate licensee is paid in the sale of a single-family home, the seller completes and signs the Real Estate Commission's seller's disclosure of conditions form when signing the listing agreement (KRS 324.360). The listing agent gives it to any buyer on request and must deliver it to the buyer within 72 hours after receiving a written, signed offer, asking the buyer to sign a copy – or noting the refusal. In an owner sale without a listing, the licensee delivers it within 120 hours after the contract.

The rules

  1. When it applies (324.360(1))

Sales of single-family residential dwellings in which a person licensed under KRS chapter 324 receives compensation.

  2. At listing (324.360(4))

The seller completes and signs the form when executing the listing agreement; a copy goes to any prospective buyer on request.

  3. 72 hours after an offer

The listing agent delivers a copy within 72 hours after receiving a written, signed offer, asks the buyer to sign it, and keeps it in the principal broker's records – or records the buyer's refusal to sign.

  4. Owner sales (324.360(5))

Without a listing, a licensee gives the owner a blank form; if completed, it goes to the buyer within 120 hours after the sale contract is created.

Good to know

  • The form covers at least the basement and roof (and whether they leak), water and sewage service, and the working condition of component systems.
  • Not required for new homes sold with a warranty, auction sales or court-supervised foreclosures (324.360(7)).
  • If the seller refuses to complete it, the licensee tells the buyer in writing without unreasonable delay (324.360(8)).
  • A licensee may not fill in any part of the form unless the owner asks in writing on the form (324.360(9)).

What the TC tracks

  • The signed form in the listing file from day one.
  • Offer received → 72 hours to deliver the form and collect the buyer's signature.
  • The original kept by the listing broker; refusals recorded on the form.
