Iowa · ForeclosureIowa nonjudicial foreclosure: a 30-day notice, then title passes and the debt ends
Iowa allows a mortgagee, at its option, to foreclose a mortgage without a court sale under chapter 655A (Iowa Code §655A.2). The mortgagee serves the mortgagor a written notice that identifies the mortgage and property, states the defaults (not counting acceleration), and warns in capital letters that within thirty days the mortgagor must cure or record a rejection with the county recorder and serve it on the mortgagee, or lose title, with the secured debt extinguished (§655A.3(1)). Copies go to the person in possession and all junior lienholders of record (§655A.3(2)). Curing the stated defaults within thirty days ends the right to foreclose for that breach (§655A.5), and a timely recorded and served rejection leaves the notice with no force or effect (§655A.6). Otherwise the mortgagee records the notice with proof of service, and without further deed it acquires the mortgagor's interest, inferior liens are extinguished and the secured debt is extinguished (§§655A.7, 655A.8). The chapter doesn't apply to agricultural real estate or to a one or two family dwelling occupied by a legal or equitable titleholder when the foreclosure begins (§655A.9).

- Look in the county records for a recorded notice, rejection or completion affidavit before closing.
