Iowa · Iowa Code §§655.1, 655.3Iowa mortgage satisfaction: 30 days after payoff, and the $500 penalty
When an Iowa mortgage is paid off, the mortgagee – or its personal representative, assignee or whoever legally acts for it – must, within 30 days of payment in full, acknowledge satisfaction by a written, acknowledged instrument that refers to the mortgage and is recorded (Iowa Code §655.1). If the mortgage secures a revolving line of credit, future advances or other future obligations, a satisfaction is required only after the mortgagor asks in writing for the release, and then within 30 days after payment in full or the request, whichever is later. A mortgagee that fails is liable to the mortgagor, heirs or assigns for all actual damages, a $500 penalty and reasonable attorney fees, claimable in an action to discharge the mortgage (§655.3) – unless it had reasonable compliance procedures, followed them in good faith and couldn't comply because of circumstances beyond its control (§655.6).
