Iowa · TitleIowa lis pendens: how the indexed petition gives notice and binds later buyers

Iowa doesn't need a separate lis pendens filing – the clerk's index does the work. When a petition affecting real estate is filed, the clerk of the district court indexes it in an index book under the tract number describing the property, with the case number, indexes any amended petition that adds parties or land, and notes the final result wherever indexed (Iowa Code §617.10). Once indexed, the action is considered pending so as to charge all third persons with notice, and while it's pending no interest can be acquired by third persons in the property as against the plaintiff's rights (§617.11(1)). A claim acquired before indexing but not of record by then is also subject to the action unless the claimant intervenes before judgment, or, before a transfer to a bona fide third party, records an affidavit showing the plaintiff had actual notice of the claim before indexing (§617.11(2)).

What the statutes set

  1. Indexing (§617.10)

The clerk indexes the petition under the property's tract number.

  2. Notice (§617.11(1))

From indexing, all third persons are charged with notice.

  3. Later interests (§617.11(1))

Can't be acquired against the plaintiff's rights while pending.

  4. Earlier unrecorded claims (§617.11(2))

Bound unless the claimant intervenes or records an actual-notice affidavit.

What the TC does when an Iowa listing has a pending case

  • Check the abstract or title opinion for any petition indexed against the tract.
  • Tell the buyer's attorney right away – an indexed case binds the buyer.
  • Track the final result noted in the index or a dismissal as a closing condition.

Questions about Iowa lis pendens

Does Iowa require a recorded lis pendens notice?

No. The clerk indexes a petition affecting real estate under the tract number, and the indexed action gives notice to all third persons (Iowa Code §§617.10, 617.11(1)).

Is a buyer bound by an Iowa case filed before closing?

Yes, once the petition is indexed: no interest acquired by third persons prevails against the plaintiff while the action is pending (Iowa Code §617.11(1)).
