Closing funds · 3 statesGood funds laws by state: wires, cashier's checks and the personal check limit

Good funds laws decide when the closing agent can pay out, so they decide how a buyer should send money. Arizona: an escrow agent may disburse only against deposits already made for that transaction – a wire received, a check available under the federal funds-availability rules, an ACH credit, or a cashier's, certified or teller's check deposited – with an exception for up to $500 per transaction (A.R.S. §6-843). Missouri: a settlement agent accepting more than $2,500 must require certified funds – currency, a cashier's, certified or teller's check, a wire unconditionally received or a qualifying real-time payment – from anyone other than a financial institution (RSMo 381.410, 381.412). Texas: a title company may not disburse until good funds equal to all disbursements are received and deposited; good funds include wires, cashier's, certified and teller's checks, and uncertified items under $1,500 (TDI Procedural Rule P-27, implementing Tex. Ins. Code §2651.202).

What each state accepts

  1. Arizona (A.R.S. §6-843)

Deposits already received: wire, available check, ACH, cashier's check deposited; $500 exception.

  2. Missouri (RSMo 381.410, 381.412)

Certified funds for amounts over $2,500; a personal check over $2,500 isn't enough.

  3. Texas (Procedural Rule P-27)

Good funds received and deposited; uncertified items under $1,500.

What the TC tells the buyer

  • Ask the closing agent which forms of funds it accepts and the cutoff for a wire.
  • Tell the buyer how to send funds to close several days before closing.
  • Have the buyer confirm wiring instructions by phone at a known number before sending money.

Questions about good funds

Can a buyer bring a personal check to closing?

Not for large amounts in these states: Missouri requires certified funds over $2,500 (RSMo 381.412), Texas treats uncertified items of $1,500 or more as good funds only once collected (Procedural Rule P-27), and Arizona disburses against a check only once it is available under the federal funds-availability rules, apart from $500 per transaction (A.R.S. §6-843).

Is a wire transfer good funds?

Yes in all three, once received: Arizona (A.R.S. §6-843(A)(1)), Missouri (RSMo 381.410) and Texas (Procedural Rule P-27).
