Florida · Fla. Admin. Code r. 69O-186.003Florida title insurance rates: what the owner's policy costs

In Florida the title insurance premium is set by rule, not negotiated: the owner's policy costs $5.75 per $1,000 of coverage up to $100,000, $5.00 per $1,000 from $100,000 to $1 million, $2.50 per $1,000 to $5 million and less above that, with a $100 minimum, and it must be issued for the full insurable value (Fla. Admin. Code r. 69O-186.003(1)). A lender's policy issued at the same time on the same land costs as little as $25, plus the regular rate on any amount above the owner's coverage (r. 69O-186.003(5)). If the seller's own owner's policy is less than three years old, lower reissue rates apply – $3.30 per $1,000 to $100,000 and $3.00 to $1 million (r. 69O-186.003(2)). On a $400,000 home the owner's premium is $2,075, or $1,230 at the reissue rate. Search, closing and endorsement charges are separate.

Premiums set by the rule

  1. Owner's policy

    $5.75 per $1,000 to $100,000; $5.00 to $1M; $2.50 to $5M; $2.25 to $10M; $2.00 above; minimum $100 (r. 69O-186.003(1)(a)).

  2. Lender's policy alone

Same scale as the owner's policy; not less than the full principal debt (r. 69O-186.003(1)(b)).

  3. Simultaneous issue

Lender's policy with an owner's policy on identical land: minimum $25 up to the owner's amount; regular rate above it (r. 69O-186.003(5)).

  4. Reissue rate

    $3.30 per $1,000 to $100,000; $3.00 to $1M; $2.00 to $10M – e.g. when the seller's owner's policy is less than 3 years old and a copy is kept (r. 69O-186.003(2)).

  5. New home discount

First sale of a new 1–4 family home never leased or occupied by the seller: credit for the builder's prior loan policy premium, minimum $200 (r. 69O-186.003(3)).

  6. Example – $400,000

    Owner's: $575 + $1,500 = $2,075. Reissue: $330 + $900 = $1,230. Simultaneous lender's policy up to $400,000: $25.

How to check the title charges

  • Ask whether the seller has an owner's policy less than three years old – and get a copy to the title agent for the reissue rate.
  • Compare the owner's premium on the Closing Disclosure with the rule's scale for the price.
  • Check the lender's policy line: with a simultaneous owner's policy it should be the $25 minimum up to the owner's amount.
  • Remember that search, closing fees and endorsements are charged separately.

What the TC gathers

  • The seller's prior owner's policy, early, if it may qualify for reissue.
  • Who pays the owner's policy under the contract.
  • The title commitment and premium quote matched to the contract price.
