FHA loans · HUD Handbook 4000.1FHA document rules: 120 days, the 180-day appraisal and who may send the buyer's papers

Three FHA rules shape a TC's work on an FHA deal. First, documents used to originate and underwrite the loan may not be more than 120 days old on the disbursement date; documents whose value does not change with time, such as divorce decrees or tax returns, may be older. Second, the appraisal is valid for 180 days from its effective date; if it will be older at disbursement, an appraisal update can extend it to one year after the original effective date. Days are counted starting the day after the document's effective or issue date. Third – and easy to get wrong – the lender must not accept or use documents about the borrower's employment, income, assets or credit that have been handled by, or sent from or through, unknown parties or interested parties such as the seller or the real estate agents. Third-party verifications may not pass through the borrower either. The lender and its loan originator may handle them.

The clocks (HUD 4000.1)

  1. 120 days

Most origination and underwriting documents, measured at the disbursement date.

  2. Older is fine

Documents not affected by time – divorce decrees, tax returns.

  3. Appraisal 180 days

    From the appraisal's effective date.

  4. Appraisal update

Extends validity to one year after the original effective date.

  5. Counting

Day one is the day after the effective or issue date, whichever is later.

Who may pass the buyer's papers to the lender

  • Not the seller, the real estate agents or anyone else with an interest in the deal – the lender may not use employment, income, asset or credit documents that went through them.
  • Third-party verifications may not pass through the borrower either.
  • The lender and its third-party originator may handle the documents.
  • Documents sent electronically are authenticated by the lender (fax banner, sender's email, or a call to the source).

What the TC does differently on FHA

  • Ask the buyer to send pay stubs, bank statements and credit letters straight to the lender – not through the agent's or the TC's inbox.
  • Track only that each item was sent; keep the content with the lender.
  • Note the appraisal's effective date and the 180th day next to the closing date.

Questions agents and TCs ask

How long are FHA loan documents good for?

Generally no more than 120 days old at the disbursement date; time-insensitive documents like tax returns may be older (HUD Handbook 4000.1).

How long is an FHA appraisal valid?

180 days from its effective date; an appraisal update extends it to one year after the original effective date.

Can the real estate agent send the buyer's bank statements to an FHA lender?

The lender may not accept or use income, asset, employment or credit documents handled by or sent through interested parties such as real estate agents; the buyer should send them to the lender directly.

In ClosingCode, track that the buyer sent each item to the lender as a task – without the financial papers ever passing through your inbox.
